Where do consumers go to file complaints?

Before registering a complaint, a consumer must confirm the Territorial and Pecuniary Jurisdiction. A consumer can register a complaint with the district consumer forum in the locality where the other party resides, conducts business, has a branch office, or personally works for pay, or where the entire or part of the cause of action occurred. You may submit a consumer complaint in-

  • District Consumer Disputes Redressal Forum (DCDRF)- If the amount of the claim is up to twenty lakhs, a complaint may be lodged there.
  • State Consumer Disputes Redressal Commission (SCDRC): If the claim's worth is greater than $20,000 but less than $1,000,000, a complaint may be filed with the appropriate State Commission. Any revision that deviates from the District Forum's order may also be submitted to the State Commission.
  • If the claim's worth exceeds one crore rupees, a complaint may be made with the National Consumer Disputes Redressal Commission (NCDRC). Additionally, any change to a State Commission order may be filed with the National Commission.

What steps must be taken and what information must be included in our consumer complaint?

Although a consumer complaint can be submitted by the complainant themselves, it is always recommended to get legal counsel for better resolution. The complaint must be clear, detailed, and accurate. Before submitting a consumer complaint, it is recommended that you issue a legal notification. Included in the consumer complaint must be-

  • The complaint must have a cause-title and heading,
  • The name, description, and address of the complainant,
  • Pertinent information about the complaint and the venue,
  • The name, description, and address of the opposing party or parties,
  • Pertinent information regarding the complaint and the venue,
  • Relevant information regarding the liability of the opposing party,
  • The complaint must be accompanied by supporting documentation for the claims made in the petition.
  • It is advisable to maintain one or two copies of the complaint on hand for recordkeeping and future proceedings.
  • The complaint must be signed by the complainant with an attestation.
  • List of documents that the complainant has duly signed must be included with the complaint.
  • The jurisdiction clause must be cited in the complaint to demonstrate how the case is within the tribunal's purview.
  • Whether the cause of action originated within the jurisdiction of the tribunal or whether the opposing party resides, conducts business, has a branch office, or personally works for gain inside the jurisdiction of the forum must be stated.
  • In addition, the complaint must state the relief sought and how the complainant is entitled to reimbursement from the opposing party for the costs associated with filing the complaint.
  • The complaint must include state the amount of the reimbursement.
  • The verification clause for the complaint must be included, and it must also be attested or notarized by an Oath Commissioner or Notarization officer.

What sort of relief can be requested in consumer court?
