Introduction
As our lifestyles change, we often use chemicals and products at home without realizing that they can be harmful to our health and the environment. These substances, known as hazardous waste, should not be disposed of with regular waste. Proper management of hazardous waste is crucial to protect our health and the environment. To ensure this, the state pollution control board provides hazardous waste management authorization.

What is Domestic Hazardous Waste?

Domestic Hazardous Waste refers to items that are discarded at the household level. These include cans of paint and pesticide, sanitary waste like disposable diapers and sanitary pads, expired medicines, broken mercury thermometers, used syringes, e-waste like tube lights and CFL bulbs, used batteries, and button cells.
Hazardous waste has properties that can be harmful to public health and the environment, such as ignitability, reactivity, and toxicity. It cannot be disposed of using standard methods due to the presence of toxic metals and flammable solvents. Children are particularly vulnerable to lead exposure, which can cause cognitive disabilities.
Examples of hazardous domestic waste include poisonous pesticides used for mosquitoes, cockroaches, and rats. Fungicides, garden herbicides, and broken glass are also considered hazardous waste due to their toxicity.

Hazardous Waste Management Rules

The Hazardous Waste Management Rules were established in 1989 and have been amended over the years to ensure safe handling, storage, treatment, transportation, and disposal of hazardous waste. These rules emphasize the responsibility of individuals involved in the collection, processing, recycling, and disposal of hazardous waste.
Different rules apply to different types of hazardous waste. Domestic hazardous waste falls under the Solid Waste Management Rules 2016, while hazardous waste generated by industries and offices is covered separately under the Hazardous Waste Rules 2016. Certain biomedical waste is included in domestic hazardous waste, but waste from healthcare establishments is covered by the Bio-medical Waste Management Rules 2016. Similarly, e-waste is regulated by the E-waste Management Rules, and lead-acid batteries from home inverters and cars are covered by the Batteries (Management and Handling) Rules 2001.

Authorities Granting Hazardous Waste Management Authorization

Several authorities are involved in the process of providing hazardous waste management authorization. These include the Central Pollution Control Board, State Pollution Control Board/Pollution Control Committee, Directorate General of Foreign Trade, Port Authority and Customs Authority, and the Ministry of Environment, Forest and Climate Change.

Who Needs Hazardous Waste Management Authorization?

Any individual or entity involved in handling, generating, collecting, storing, packaging, transporting, treating, processing, recycling, or disposing of hazardous waste must obtain hazardous waste management authorization from the state pollution control board. They are responsible for the safe and environmentally friendly management of hazardous waste and must take necessary measures to prevent accidents and limit adverse effects on humans and the environment. Additionally, they should provide protective equipment and training to ensure the safety of workers.

Consequences of Improper Hazardous Waste Management

Improper management of hazardous waste can have severe consequences for human health and the environment. It can lead to pollution, soil contamination, water pollution, global warming, and harm to marine life. Proper management is essential to preserve the environment and protect future generations.

List of Hazardous Wastes

There is a list of hazardous wastes categorized under various Basel numbers. These include metal and metal-bearing waste, non-ferrous metal waste, electrical and electronic assemblies, organic waste containing metals and inorganic materials, and paper waste.

List of Recyclable Hazardous Wastes

There is also a list of hazardous wastes that can be recycled. These include brass dross, copper dross, copper oxide mill scale, waste copper and copper alloys, spent metal catalysts, used oil, and waste oil.

Procedure to Obtain Hazardous Waste Management Authorization

To obtain hazardous waste management authorization, follow these steps:
  1. Submit an application in Form I to the state pollution control board within 60 days of the publication of these rules.
  2. Include "consent to establish" and "consent to operate" with the application.
  3. Attach all necessary documents and ensure they are signed by an authorized person.
  4. Submit the application to the relevant state pollution board.
  5. If the board approves the application, hazardous waste management authorization will be granted.

Required Documents

The following documents are required for hazardous waste management authorization:
  • Aadhaar Card and PAN card copies of the applicant
  • GST certificate
  • Rent/lease agreement or proof of ownership
  • Factory or trade license
  • Electricity bill
  • Layout plan
  • Certificate of incorporation for companies/LLPs
  • MOA and AOA
  • Board resolution appointing an authorized person

Validity of the Authorization

Hazardous waste management authorization is valid for 5 years. To renew the authorization, an application must be submitted at least 120 days prior to the expiry date.
