There is no need to be concerned if you have received a product that is faulty, defective, or damaged and the seller refuses to replace it or refund your money because the government created a law known as the Consumer Protection Act, 1986 (the Act), which addresses consumer complaints and resolves issues with regard to damaged or faulty goods.
What are the different rights that the Act assures to the consumers?
Customers' rights are protected by the act under these headings-
- Right to safety- Act protects consumers against the marketing of harmful products and services.
- Right to information- The legislation protects consumers from unfair commercial practices and informs them about the standard, price, quality, quantity, and potency of goods and services. For instance, in the case of medicines, pharmaceutical companies must disclose any possible side effects, and drug producers must publish laboratory reports about their products in order to encourage a comparison of their products with those of rival brands.
- Right to choose- The ability to select from a wide range of goods at the best possible prices. The government has made it illegal to organize cartels to establish monopolies in order to offer consumers a range of goods at competitive prices. As a result, suppliers of comparable goods or services cannot get together to undermine the consumers' negotiating position.
- Right to be heard- The act guarantees that consumers' interests will be given appropriate regard and grants them the right to be heard. Numerous complaint-handling forums have been established at the district, state, and national levels to enable customers to bravely make a complaint against flawed or defective goods in order to fulfil this entitlement.
- Right to redressal- The Act establishes a number of redressal forums at the district, state, and national levels to give consumers the opportunity to seek redress against unfair commercial practices, restricted trade practices, and dishonest consumer exploitation.

What should you do if your rights were violated?
Several legal remedies are available to us if your rights have been violated. However, customers must be aware of the laws and regulations in order to effectively resolve complaints. They also need to grasp these laws and regulations in their entirety. In order to handle matters involving consumer disputes and grievances, the law has established consumer courts at the district, state, and national levels. A customer may complain to an Indian consumer court if they believe that one of their rights has been violated. Consumer courts were primarily established to ensure that businesses treated customers fairly.
When can a consumer complaint can be filed?
Any Consumer may submit a written complaint to the Consumer Court alleging that their rights have been violated. In the instances listed below, a complaint may be made-
- When a trader or service provider engages in unfair or restrictive business practices;
- When a product is subpar in terms of quality, standard, or measure established by a competent authority;
- When a consumer hires or uses services that are limited in some way;
- When a trader or service provider charges more than the agreed-upon price; and
- When hazardous goods or services are offered for sale in public violating public safety
Where do consumers go to file complaints?
Before registering a complaint, a consumer must confirm the Territorial and Pecuniary Jurisdiction. A consumer can register a complaint with the district consumer forum in the locality where the other party resides, conducts business, has a branch office, or personally works for pay, or where the entire or part of the cause of action occurred. You may submit a consumer complaint in-
- District Consumer Disputes Redressal Forum (DCDRF)- If the amount of the claim is up to twenty lakhs, a complaint may be lodged there.
- State Consumer Disputes Redressal Commission (SCDRC): If the claim's worth is greater than $20,000 but less than $1,000,000, a complaint may be filed with the appropriate State Commission. Any revision that deviates from the District Forum's order may also be submitted to the State Commission.
- If the claim's worth exceeds one crore rupees, a complaint may be made with the National Consumer Disputes Redressal Commission (NCDRC). Additionally, any change to a State Commission order may be filed with the National Commission.
What steps must be taken and what information must be included in our consumer complaint?
Although a consumer complaint can be submitted by the complainant themselves, it is always recommended to get legal counsel for better resolution. The complaint must be clear, detailed, and accurate. Before submitting a consumer complaint, it is recommended that you issue a legal notification. Included in the consumer complaint must be-
- The complaint must have a cause-title and heading,
- The name, description, and address of the complainant,
- Pertinent information about the complaint and the venue,
- The name, description, and address of the opposing party or parties,
- Pertinent information regarding the complaint and the venue,
- Relevant information regarding the liability of the opposing party,
- The complaint must be accompanied by supporting documentation for the claims made in the petition.
- It is advisable to maintain one or two copies of the complaint on hand for recordkeeping and future proceedings.
- The complaint must be signed by the complainant with an attestation.
- List of documents that the complainant has duly signed must be included with the complaint.
- The jurisdiction clause must be cited in the complaint to demonstrate how the case is within the tribunal's purview.
- Whether the cause of action originated within the jurisdiction of the tribunal or whether the opposing party resides, conducts business, has a branch office, or personally works for gain inside the jurisdiction of the forum must be stated.
- In addition, the complaint must state the relief sought and how the complainant is entitled to reimbursement from the opposing party for the costs associated with filing the complaint.
- The complaint must include state the amount of the reimbursement.
- The verification clause for the complaint must be included, and it must also be attested or notarized by an Oath Commissioner or Notarization officer.
What sort of relief can be requested in consumer court?
- For the purpose of fixing flaws in the faulty products or fixing errors in the mentioned services;
- For the return of the disputed products or the trader's payment's refund;
- Payment of damages for losses incurred or injuries sustained
- To stop or promise not to repeat the restrictive or unfair trade practices in the future;
- Preventing disputed hazardous goods from being marketed for sale;
- To cease producing dangerous goods and refrain from providing services that are dangerous in nature;
- Paying compensation in an amount equal to at least 5% of the value of the defective products or services, as decided by the forum, if a significant number of customers have experienced loss or harm;
- Should stop or change the deceptive commercial to lessen its impact.
Recent Consumer Rights Developments in India
The Lok Sabha enacted the Consumer Protection Bill, 2018 in December 2018 to replace the Consumer Protection Act, 1986, which allows for the recall of faulty products and allows customers to seek compensation for subpar goods or services. Additionally, his bill set forth sanctions for the production and distribution of contaminated goods that endanger human life and health. In the event that a death is brought on by a tainted product, a recommendation for a 7-year life sentence and a minimum punishment of 10 lakh Indian rupees has been made.
