Overview

  • Applications for several classes
    In Egypt, applications for trademarks in multiple classes are permitted. However, if one of the classes receives an objection, it is advised to submit a single-class application to assist minimize needless delay in the registration processing.
  • Egypt's filing requirements
    Arabic is used exclusively in court proceedings before the Egyptian Trademarks and Industrial Designs Office. A trademark application in Egypt must include the following information in order to obtain the date of filing-
    • A request for registration of a trademark;
    • The applicant's name and address;
    • A list of the goods and/or services;
    • A representation of the trade mark; and
    • Documentation of the payment of the required fees.
    • A certified copy of the Priority Document must be submitted within three months of the filing date if priority is being asserted.
    • It is necessary to legalize the Power of Attorney in Arabic all the way to the Egyptian Consulate. It may be filed concurrently or within six months of the date the trademark application was filed.
    • It takes six months from the priority date to file a trademark application in Egypt that claims conventional priority.
  • Egyptian trademark application publication, opposition, and review
    In Egypt, trademark applications must pass a thorough and in-depth review. The decision accepting the application for the registration of the trademark will be published in the Official Gazette if the Trademark Office has approved the trademark application. Within 60 days of the date the judgement was published, anybody may contest the registration of a trademark.
  • Grant, duration of validity, and renewal of a trademark
    2 months after the opposition period has ended, the official registration cost must be paid. In Egypt, trademarks have a 10-year initial validity duration that is perpetually renewed for additional 10-year periods. It is necessary to submit a request for renewal during the final year of the protection period. After the renewal deadline has passed, a trademark may be renewed within six months as long as the associated fee has been paid.
  • The duration of registration process
    If no objections are voiced, the processing time ranges between 18 and 24 months from the first file to registration.
  • Use requirement
    If a trademark registration in Egypt has not been used for five years following registration, it may be revoked on the basis of non-use at the request of a third party.
  • Using a trademark attorney as representation
    Before the Trademarks and Industrial Designs Office, foreign applicants must appoint an Egyptian registered trademark attorney to act on their behalf.

Trademark Registration

Since Egypt is a "first to file" jurisdiction, trademark registration is required in order to be given rights over a trademark. An unregistered trademark can only be protected in some rare circumstances. The Egyptian trademark office must receive the trademark applications (EGYPO). Member of the Madrid Protocol is Egypt. As a result, this nation is able to extend an international trademark registration under the Madrid System. A trademark does not have to be in use in Egypt in order to register.

If you register a combination trademark in Egypt that has both word and figurative elements, you are only granted the exclusive right to use the mark in the same manner in which it was submitted and registered. It is advised that you file for a different trademark that only includes the word or figurative features you intend to use and protect separately. This is true if you wish to use the word element of your trademark separately from the logo (or vice versa). A trademark application may be the subject of opposition actions from third parties within sixty (60) days of the date it was published in the official gazette. Although a trademark need not be utilized in order to register, it cannot stay inactive for more than five years at a time as this leaves it open to revocation claims based on inactivity.

In Egypt, registered trademarks are valid for ten (10) years after the application date and may be renewed indefinitely for additional ten-year periods. During the grace period of six (6) months following the expiration of the trademark, the renewal may still be requested with the payment of a late renewal charge.

The trademark must be written in the Latin alphabet, and only other Latin-written trademarks will be taken into consideration for trademark search reports.
